Registration for supervised services from the company Les Volatiles implies pure and simple acceptance of these general conditions by the subscriber, who undertakes to inform each participant of all the terms and conditions.

ART. 1 – SPEAKERS
The company Les volatiles offers, on behalf of independent instructors, supervision and teaching of outdoor sports disciplines. All activities offered are supervised and provided by state-certified instructors (B.E.E.S / B.P.J.E.P.S) in their respective disciplines and meeting their legislative obligations (U.R.S.S.A.F, R.C.P, D.D.C.S.P.P declaration, professional cards).

ART. 2 – REGISTRATION AND RESERVATION

All our activities are by reservation. For this, you have several solutions: by completing the online reservation form or by contacting Les Volatiles directly by email (contact@les-volatiles.com), by telephone (+33 4 79 389 554) or at reception of our structure at 196 avenue des JeuxOlympics 73620 Les Saisies
Registration is effective from the moment the subscriber receives a message by email or SMS confirming the reservation for the chosen activity.

Registration is effective upon receipt of the deposit corresponding to 100% of the total amount of the service and a reservation confirmation email for the chosen activity.

In both cases, the balance will be paid directly to the professional in his own name, at the start of the activity.

ART. 3 – PRICE

The prices of the company Les Volatiles are presented on the website and in the catalog of activities available at reception.

Prices include: organization, supervision provided by a state-certified guide and the loan of technical and safety equipment necessary for the practice of the chosen activity.

Some products include the possibility of loaning equipment, upon simple request.

In all cases, we invite you to refer to the product technical sheet, available on our website or on request.

Prices do not include: possible rental of equipment (e.g. Go Pro p) and personal expenses.

For day trips, meals (picnic, water, snack) are the responsibility of the customer, unless otherwise stated.

For outings lasting 2 days or more, additional costs such as overnight stays, meals and snacks are the responsibility of the customer and must be paid directly to the accommodation provider/restaurateur.

ART. 4 – PAYMENT METHOD

For supervision services, payment must be sent (worded) directly to the instructor providing the session, in his own name or to the attention of the company Les Volatiles. This notice will be stipulated when booking.

Accepted means of payment: check, holiday voucher, bank transfer, bank card (secure internet payment) or internet payline cash.

ART. 5 – CONDITIONS OF PARTICIPATION
Our activities are open to all; However, depending on the activities, certain conditions must be taken into account (age limit, technical level, physical condition, etc.).
The company Les Volatiles does not have the means to check the level of sports practice of its customers.
It is therefore up to each participant to have assessed their physical fitness based on the choice of activity they wish to carry out. To find out about these conditions, please refer to the activity technical sheets (available on our site).

You must not have any medical contraindication to practicing the chosen activity.

IMPORTANT: You are not subject to a medical contraindication but you are dependent on special medical care or treatments (asthma, diabetes, etc.) or your state of health requires special attention (fragile joint, problem back, compulsory wearing of glasses, etc.), you must inform the instructor before starting the activity and provide appropriate emergency medication, according to medical recommendations.

ART. 6 – INSURANCE AND LIABILITY

Each instructor/professional is insured under Professional Civil Liability for their own activities and for costs incurred by a possible rescue operation.

We strongly advise each participant to be covered by civil liability insurance and/or individual accident insurance with the insurance of their choice for practicing mountain air sports. Indeed, we cannot replace the individual civil liability of each participant.
SARL Les Volatiles is insured for civil liability for all the activities it offers and cannot be held liable for activities booked with other providers.

In the event of a bodily accident, the responsibility of SARL Les Volatiles and the intervening instructor is released as soon as the victim is taken care of by the competent emergency organizations, and any hospital treatment will be the responsibility of the accident victim’s personal insurance ( e).
The practice of outdoor activities takes place in a specific environment called “at risk”.
Each participant is aware, given the specific nature of the activities proposed, that they may run certain risks due in particular to the specific nature of the environment. He assumes them with full knowledge of the facts and must comply with the rules of caution and follow the advice given by professionals.
The participant/client is responsible for the equipment loaned to them for the activity. The professional cannot be held responsible for any damage that may be caused by the equipment made available.

In the event of theft or damage to the equipment loaned, the participant/customer may be asked for compensation related to wear and tear or a full refund of the equipment.
The professionals (instructors) and the SARL Les Volatiles cannot be held responsible for the loss, theft (including from vehicles) or breakage of objects (e.g. glasses, cameras, etc.) that practitioners could take with them. with them during the activity and able to provide for themselves during the activity.

ART. 7 – CANCELLATION / INTERRUPTION BY THE CUSTOMER

7.1 Cancellation by customer and fees

– Cancellation of a reservation between 20 and 30 days before the appointment date: total refund of the deposit or the activity minus the fees imposed see article 8.1.1

– Cancellation of a reservation 19 to 10 days before the appointment date: the deposit is retained or the payment refunded at 65%

– Cancellation of a reservation 9 to 6 days before the appointment date: the deposit is retained or the payment refunded at 50%

– Cancellation of a reservation 5 to 4 days before the appointment date: the deposit is retained or the payment refunded at 40%

– Cancellation of a reservation less than 3 days from the appointment date: the balance will be required or the payment kept.

No refund can be requested by the customer in the event of cancellation on their part 6 hours before their appointment date

In all cases, the customer undertakes to notify the company Les Volatiles of all notifications relating to the reservation: organization of the program, change in staff, delay or cancellation.

7.2 – Interruption during performance
In the event of an interruption during the service, the customer or participant will not be able to claim any reimbursement.

ART. 8 – CANCELLATION / EXCLUSION DUE TO THE COMPANY LES VOLATILE

8.1 – Cancellation

Les Volatiles company instructors reserve the right to cancel or adapt the outing depending on weather conditions or the level of participants for snowmobile and paragliding activities.
In the event of a snowmobile or paragliding cancellation by us, due to an insufficient number of participants, or unfavorable weather (estimated by the instructors), registrants will be fully refunded without being able to claim any compensation, except vouchers. gifts
which are not reimbursed (see art 11).
The Paragliding activity may be canceled for safety reasons (weather, unavailability, etc.) or for any other case of force majeure. In this case, a replacement activity will be organized if possible or another date will be offered to you. If the activity cannot be carried out, the service will be postponed or reimbursed without being able to claim any compensation, except gift vouchers which are not reimbursed.

8.1.1 – Cancellation

In the event of reimbursement, fees will be applied according to the payment methods. These fees correspond to the bank fees imposed on us and the website commissions imposed on us and file processing fees.

Cash payment: full refund, no fees

CB payment: reimbursement – 2% BANK FEES (2% on payment and 0% on reimbursement of bank charges)

Website payline settlement: reimbursement – 10% FEES (2% on payment and 8% website service provider commissions)

8.2 – Exclusion

Les Volatiles company instructors reserve the right to exclude a participant who is intoxicated or whose behavior is likely to disrupt the smooth running of the activity or compromise the safety of the group. In this case, the customer or participant will not be able to claim any reimbursement or compensation.

ART. 9 – APPOINTMENT

A meeting time and place are systematically communicated to you whatever the service. For the smooth running of the activities and out of respect for the other participants and the professional who supervises you, we kindly ask you to read the road maps and other indications previously transmitted by us. Be sure to plan your journeys so that you are punctual. We tolerate a delay of up to 15 minutes. Beyond this period, the instructors leave for activities and no reimbursement or compensation will be due.
ART. 10 – SUPERVISION OF YOUTH (MINORS)

Unaccompanied minors:

Minors under the age of 14 not accompanied by an adult (legal guardian) are not accepted in activities specific to free flight.

Unaccompanied minors aged 14 to 18 can be accepted in activities specific to free flight, subject to parental authorization and under certain conditions (sporting level, skill, etc.)

In this case, parental authorization will be signed by the legal representative on the day of the activity.

ART 11. GIFT VOUCHER
The gift voucher is effective upon receipt of the full amount of the service.
The order form is nominative. However, it can be transmitted to the person of your choice provided you notify us in advance to modify the contact details of the new beneficiary.

The recipient of the gift voucher can and must register online.

The gift voucher activity can be replaced by another activity offered by the company Les Volatiles, provided that the value of the latter is less than or equal to the activity mentioned on the gift voucher. PLEASE NOTE: The gift voucher has an expiry date. After the validity period (current year), the service will be considered performed and cannot be postponed. If the gift voucher has expired for less than 72 hours, you can benefit from 50% towards the redemption of the activity.
The gift voucher and the nominative document must be presented on the day of the outing to the instructor in charge of the session.
The outing will be guaranteed if the minimum number of participants required is ensured and if the weather conditions allow the activity to be carried out properly.
The beneficiary and/or the buyer will not be able to claim any reimbursement or compensation.

All gift vouchers have a validation or duration date.

This can be modified before the end of validity date after agreement with Sarl Volatile.

Once the validity date of the gift voucher has passed, it will no longer be valid, and no dispute will be possible and no compensation will be granted.

ART. 12 – SETTLEMENT OF DISPUTES
The parties will endeavor to resolve amicably any difficulties that may arise in the execution of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and execution of this agreement will be governed exclusively by the rules of French law.

All disputes, of whatever nature, will fall within the jurisdiction of the French civil and commercial courts, including ruling on summary proceedings.

II. EQUIPMENT RENTAL

ART. 1 – RÉSERVATION

All our activities, including equipment rental, are by reservation. For this, you have several solutions: by completing the online reservation form or by contacting the company Les Volatiles directly by email or by telephone.

The reservation is effective from the moment the subscriber receives a reservation confirmation message by email or SMS.

ART. 2 – PAYMENT METHOD

The payment must be addressed (worded) to Les Volatiles.

Accepted means of payment: check, holiday vouchers, bank transfer, credit card or cash.

A deposit of €150 is required for each equipment rented and will be refunded when the equipment is returned. The balance will be paid upon delivery of the equipment.

Opening hours are mentioned when handing over equipment, in the event of late return (outside opening hours) an increase of €20 will be required and due.

ART. 3 – INSURANCE AND LIABILITY

In the case of practicing sports with equipment, and especially in the case of rental of sports equipment (excluding activities supervised by an instructor) the customer acknowledges having sufficient knowledge and technical skills to practice this sporting activity alone. In this case, the customer carries out the activity for which the said equipment is rented under full responsibility and at his own risk. SARL Les Volatiles cannot be held responsible in the event of an accident that may occur during said unsupervised activity.

The team and the SARL Les Volatiles do not have the means to verify the level of sporting practice of its clients, it is therefore up to each participant/client to have evaluated their physical fitness, knowledge and skills based on this. that he wishes to achieve.

ART. 5 – INSURANCE

6.2 Cancellation by the company Les Volatiles
SARL Les Volatiles reserves the right to cancel an activity for security reasons (weather, unavailability, etc.) or for any other case of force majeure. In this case and wherever possible, another date/slot will be offered to the customer. If the exit cannot be carried out, the amount paid will be fully refunded without being able to claim any other compensation.
6.3 Exclusion / refus de location de matériel

This contract binds the parties (pilot, passenger, signatory of this contract), their successors, heirs, assigns and other legal representatives. In the event of a dispute, the Albertville Court will have sole jurisdiction and designated for judgment.

Without this insurance, the pilot’s liability is total and the material and bodily costs incurred will be his responsibility. The deposit will amount to €1500.
